Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DaleCupon mobile application and website (collectively, the "Service") operated by DaleCupon ("Company", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 13 years old, have read and understood these Terms, and agree to comply with them. If you do not agree, please discontinue use of the Service immediately.

2. Description of Service

DaleCupon is a platform that connects consumers with local businesses offering deals and coupons. Users can discover deals on an interactive map, earn in-app coins by engaging with deals, and redeem those coins for additional discounts at participating businesses.

3. User Accounts

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activities that occur under your account.
• You agree to provide accurate and current information during registration.
• You may not create accounts for others without their express consent.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Coins & In-App Rewards

DaleCupon coins are virtual, in-app rewards with no monetary value and cannot be exchanged for cash. Coin balances earned on a given calendar day expire at midnight (local time) of that same day. The Company reserves the right to modify, suspend, or terminate the coin system at any time without prior notice. Coins may be redeemable at participating businesses at their sole discretion.

5. Business Accounts

Businesses using the Service to post deals and coupons agree to:

• Provide accurate and non-misleading deal information.
• Honor all published coupons and deals during their stated validity period.
• Comply with all applicable consumer protection and advertising laws.
• Not post deals that are illegal, fraudulent, or harmful.

The Company reserves the right to remove any deal or business account that violates these Terms.

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful or fraudulent purpose.
• Abuse, manipulate, or exploit the coin or rewards system.
• Attempt to access or tamper with other users' accounts or data.
• Upload or transmit malicious code, spam, or harmful content.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use automated tools to scrape, crawl, or extract data from the Service.

7. Intellectual Property

All content on the Service, including logos, text, graphics, and software, is the property of DaleCupon or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DALECUPON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED $100 USD.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the effective date. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms.

Estos Términos de Servicio ("Términos") rigen el acceso y uso de la aplicación móvil DaleCupon y el sitio web (conjuntamente, el "Servicio") operado por DaleCupon ("Empresa", "nosotros" o "nuestro"). Al acceder o usar el Servicio, aceptás quedar vinculado por estos Términos.

1. Aceptación de los términos

Al crear una cuenta o usar el Servicio, confirmás que tenés al menos 13 años, que leíste y comprendiste estos Términos y que aceptás cumplirlos. Si no estás de acuerdo, por favor dejá de usar el Servicio de inmediato.

2. Descripción del Servicio

DaleCupon es una plataforma que conecta a consumidores con negocios locales que ofrecen ofertas y cupones. Los usuarios pueden descubrir ofertas en un mapa interactivo, ganar monedas virtuales al interactuar con las ofertas y canjearlas por descuentos adicionales en negocios participantes.

3. Cuentas de usuario

• Sos responsable de mantener la confidencialidad de tus credenciales de acceso.
• Sos responsable de todas las actividades que ocurran bajo tu cuenta.
• Aceptás proporcionar información precisa y actualizada al registrarte.
• No podés crear cuentas para terceros sin su consentimiento expreso.
• Nos reservamos el derecho de suspender o dar de baja cuentas que violen estos Términos.

4. Monedas y recompensas

Las monedas DaleCupon son recompensas virtuales sin valor monetario y no pueden canjearse por dinero en efectivo. Los saldos de monedas ganados en un día calendario determinado vencen a medianoche (hora local) de ese mismo día. La Empresa se reserva el derecho de modificar, suspender o terminar el sistema de monedas en cualquier momento sin previo aviso. Las monedas podrán canjearse en negocios participantes a exclusiva discreción de cada negocio.

5. Cuentas empresariales

Los negocios que usen el Servicio para publicar ofertas y cupones aceptan:

• Proveer información de ofertas precisa y no engañosa.
• Respetar todos los cupones y ofertas publicados durante su período de vigencia.
• Cumplir con todas las leyes de defensa del consumidor y publicidad vigentes en Argentina (Ley 24.240).
• No publicar ofertas ilegales, fraudulentas o perjudiciales.

6. Conductas prohibidas

Aceptás no:

• Usar el Servicio para fines ilegales o fraudulentos.
• Abusar, manipular o explotar el sistema de monedas o recompensas.
• Intentar acceder o manipular cuentas o datos de otros usuarios.
• Cargar o transmitir código malicioso, spam o contenido dañino.
• Hacer ingeniería inversa, descompilar o desensamblar ninguna parte del Servicio.
• Usar herramientas automatizadas para extraer datos del Servicio.

7. Propiedad intelectual

Todo el contenido del Servicio, incluyendo logotipos, textos, gráficos y software, es propiedad de DaleCupon o sus licenciantes y está protegido por la Ley 11.723 de Propiedad Intelectual de Argentina y demás normas aplicables. Se te otorga una licencia limitada, no exclusiva e intransferible para usar el Servicio con fines personales y no comerciales.

8. Exención de garantías

EL SERVICIO SE PROVEE "TAL CUAL" Y "SEGÚN DISPONIBILIDAD" SIN GARANTÍAS DE NINGÚN TIPO, EXPRESAS O IMPLÍCITAS. NO GARANTIZAMOS QUE EL SERVICIO SEA ININTERRUMPIDO, LIBRE DE ERRORES O VIRUS. EN LA MEDIDA PERMITIDA POR LA LEY ARGENTINA, EXCLUIMOS TODA RESPONSABILIDAD POR DAÑOS DERIVADOS DEL USO DEL SERVICIO.

9. Limitación de responsabilidad

EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEGISLACIÓN ARGENTINA (LEY 24.240 Y NORMAS CONCORDANTES), DALECUPON NO SERÁ RESPONSABLE POR DAÑOS INDIRECTOS, INCIDENTALES, ESPECIALES O CONSECUENTES QUE SURJAN DEL USO DEL SERVICIO. NUESTRA RESPONSABILIDAD TOTAL POR CUALQUIER RECLAMO NO EXCEDERÁ EL EQUIVALENTE A $100 USD EN PESOS ARGENTINOS AL TIPO DE CAMBIO OFICIAL VIGENTE.

10. Ley aplicable

Estos Términos se rigen por las leyes de la República Argentina. Cualquier controversia derivada de estos Términos se someterá a la jurisdicción de los Tribunales Ordinarios de la Ciudad Autónoma de Buenos Aires, renunciando expresamente a cualquier otro fuero que pudiera corresponder.

11. Cambios en los términos

Nos reservamos el derecho de modificar estos Términos en cualquier momento. Notificaremos los cambios relevantes actualizando la fecha de vigencia. El uso continuado del Servicio tras cualquier modificación implica la aceptación de los Términos revisados.
